组成司法院大法官会议的成员。但根据现行《中华民国宪法增修条文》第五规定，司法院设大法官十五人，由总统提名，经立法院同意任命之。司法院大法官任期八年，不分届次，个别计算，并不得连任。司法院大法官除解释《宪法》，统一解释法律及命令，并组成宪法法庭审理政党违宪之解散事项。
